TESIS Panel Lawyer Recruitment Notification (Re-Notification)

Applications are invited from legal professionals with the following qualifications and experience for the purpose of appointing one or more panel lawyers for Telephone Industry Limited (TESHIS) under the Department of Posts and Telecommunications. 2 (Two) copies of passport size photographs along with attested copies of educational and all experience certificates should be sent to the Managing Director, Telephone Industries Ltd., Tongi, Gazipur-1710 by registered post by 18th April 2024 AD. Application can also be made by appearing directly during the office hours during that period.

Qualification and Experience:

01. Educational Qualification: Candidate should have minimum graduation in Law. Preference will be given to applicants with higher degrees in law. Third division/class is not acceptable at any stage of education level.

02 Rayas: Candidate age should be minimum 30 years and maximum 60 years as on 18th April 2024 AD.

03. Experience:

(a) The candidate must be an advocate enrolled in the High Court Division of His Highness the Supreme Court of Bangladesh. Applicants listed in Appellate Division will get priority.

(b) Must have at least 5 (five) years of experience as a lawyer in various jurisdictional courts of Bangladesh, including at least 3 (three) years of experience in the High Court Division of His Highness Bangladesh Supreme Court.

(c) To acquaint the candidate with civil law, criminal law, labor law, company law, contract law, land law, administrative law, transfer of property law, arbitration law, collection of government dues, employment regulations, various telecommunication related policies and writ administration. Must have experience.

(d) Candidates who have worked as legal advisers in any organization in the telecom sector and have special skills in civil, criminal and contract law will be given preference.

(e) Should have experience of working as Legal Adviser in Government/ Autonomous/ Government-Owned Institutions.

04. Candidate must be physically and mentally fit and a citizen of Bangladesh.

05. Remuneration: Candidates considered for appointment as Panel Lawyers will be entitled to retainer fee and consultant fee (after deduction of applicable income tax) at fixed/ negotiable rate after completion of contract. The applicable VAT will be paid by Teshis.

06. Contract Period : 02 (two) years. Renewable if necessary by negotiation and consent of both parties.

07. Short list will be prepared after screening of applications received from interested candidates. Shortlisted candidates will be invited for interview. After the interview the candidate will be invited to sign the contract as per the merit list of the person selected as the legal advisor of the company. Note that no allowance will be given for appearing in the interview.

08. Telephone Industries Limited (TESHIS) reserves the right to accept/reject any or all applications without assigning any reason. Incomplete/not attaching the required proof will be treated as rejected. The Authority reserves the right to request clarifications/proofs and fresh information from the applicants. The decision of the Company regarding the appointment of Panel Counsel shall be final. Note that the candidates who applied earlier (Notification No. 14,36,0000.007,11,20,22-047 Date: 02/10/2023 AD) need not apply again.

09. Scope of work of panel lawyer:

01. Giving opinion on the filing of cases in the High Court after the verdict of the case related to Tesis in the lower court and high court

02. To give an audited opinion whether the RG is correct in filing a case on behalf of the organization.

03. Giving an opinion after examining whether the answer of the organization is correct in the case filed against the organization.

04. To properly supervise the cases related to TES and advise for appropriate action.

05. Providing legal advice on administrative and financial matters in case of suspension in any court case related to Teshis.

06. Providing legal opinion on any immovable property dispute of Teshis.

07. Providing vetting/opinion on the terms of agreement with various partners of Teshis.

08. Assisting the organization in appointing senior lawyers and arbitrators in High Courts or Arbitral Tribunals in handling various cases in particular fields.

09. Duly discharge any responsibilities related to the Act given by the Department of Posts and Telecommunications and TESIS.

10. Providing legal assistance in applicable cases on request of authorities.
